Release of Liability, Assumption of the   Risk and Indemnity Agreement (“Agreement”)    To the best of my knowledge, I am in good physical condition and fully able to  participate in, and/or use, any and all of the programs, activities, services, and/or equipment (collectively, the “Programs and Activities”) offered by Steel MMA and  Fitness (“Steel MMA”) at its facility.  I am fully aware of the risks and hazards connected  with my use of, or presence at, the Steel MMA facility and/or my participation, in all or  any of part of the Programs and Activities at Steel MMA including, but not limited to,  Brazilian jiu‐jitsu, Muay Thai, kickboxing, weightlifting, MMA, aerobics or any activity or  use of equipment, including physical injury or even death, and I hereby elect to  voluntarily observe and/or participate in any or all Programs and Activities, knowing that  the associated physical activity and/or my presence at the Steel MMA facility may be  hazardous to me and my property.  I voluntarily assume full responsibility for any risks  or loss, property damage, or personal injury, including death, that may be sustained by  me, or loss or damage to property owned by me, as a result of my observation of or  participation in any of Steel MMA’s Programs and Activities.  I further certify that I am at  least 18 years of age.  If I am under 18 years of age, my parent/guardian has signed  below.      

 

I, on behalf of myself and my personal representatives, heirs, executors, administrators,  agents, and assigns, hereby release, waive and discharge, Steel MMA, their members,  managers, officers, directors, employees, volunteers, agents, independent contractors,  insurers, successors, and assigns, (hereinafter collectively referred to as “Steel MMA”)  from any and all liability, claims, demands, actions, and causes of action whatsoever  arising out of or related to any loss, damage, or injury, including death, that may be  sustained by me, or to any property belonging to me, while participating in any Steel  MMA Programs and Activates, or physical activity, or while on or upon the Steel MMA  facility whether caused in whole or in part by the negligence of Steel MMA, anyone on 
Steel MMA’s behalf or anyone else whether related to exercise, Programs and Activities,  or not.

 

I agree to indemnify, defend, and hold Steel MMA harmless against any claims, causes  of action, demands, liability, damages, defense costs, including attorneys’ fees, or from  any other costs or expenses incurred in connection with claims for bodily injury,  wrongful death or property damage caused in whole or in part by my representations,  intentional conduct, negligence or other wrongful acts or omissions.  I further agree to  hold harmless, defend, and indemnify Steel MMA from all any claims, causes of action,  demands, liability, damages, defense costs, including attorneys’ fees, or from any other  costs or expenses incurred in connection with claims for bodily injury, wrongful death,  or property damage brought by me, my guests or minors.   

 

I hereby further agree that this Agreement shall be construed in accordance with the  laws of the State of California.

In signing this Agreement:   

 

1 I understand that Steel MMA is relying this Agreement as consideration for  providing me access to its facility and the Programs and Activities;  

 

2 I acknowledge and represent that I have read all the terms in this Agreement,  I understand them and I sign this Agreement  voluntarily as my own free act  and deed;  

 

3 I agree that there are no oral representations, statements or inducements,  apart from the foregoing written agreements have been made; and,  

 

4 I execute this release for full, adequate and complete consideration fully  intending to be bound by same.
